Terms of Service

1. Who offers the service, and what you accept

SmartSheet (“the Service”) is offered by Maurizio Bellifemine, who can be reached at maury.bellifemine@gmail.com. By using the Service you accept these terms. If you do not accept them, do not use it.

The Service is free and offered as an experimental demo: no payment and no subscription to cancel. Generating a SmartSheet does require an account, and you sign in with Google: SmartSheet neither creates nor stores passwords.

The account is yours and stays yours: you delete it whenever you like from the archive inside the app, and every saved SmartSheet goes with it. You need no one’s permission and you do not have to write to us.

An account is personal: the Google credentials you sign in with are not to be shared, and whoever uses the account answers for the SmartSheets generated from it.

2. What SmartSheet is

SmartSheet generates condensed study material (“SmartSheets”) from notes, PDF files, images or text that you upload, processing them through the Google Gemini artificial intelligence APIs. It then lets you edit them with a chat and export them to PDF.

3. Minimum age

You may use the Service on your own if you are at least 14 years old. If you are under 14, the Service must be used by a parent or guardian, or with their authorisation.

4. What not to upload

You also undertake not to upload or generate:

• illegal, offensive, defamatory or hateful material;
• material covered by third-party rights that you have no right to use — for example other people’s copyrighted textbooks or handouts;
• sensitive data (health, political or religious opinions, sexual orientation, judicial data), yours or anyone else’s;
• content meant for academic fraud, or for any unlawful use.

You also undertake not to attempt to circumvent the Service’s technical limits, not to access its systems without authorisation, and not to use it in an automated way to saturate its capacity.

5. Who owns the content

The material you upload stays yours: the Service claims no ownership of it and does not use it for its own purposes. No ownership is claimed over the generated SmartSheets either, and you may freely use them to study — bearing in mind that they derive from the material you provided, and that if that material is protected by third-party rights, those rights still apply.

The code, the design and the SmartSheet name remain the property of whoever created them.

6. Limits of what the Service can do

SmartSheets are produced by an artificial intelligence model: they may contain errors, inaccuracies, wrong simplifications or omissions, even when they look correct. Checking the content before studying it or handing it in is your responsibility. The Service guarantees neither accuracy, completeness nor fitness for a particular purpose, and it does not replace studying the original material.

7. Liability

The Service is provided free of charge and “as is”. To the extent permitted by law, no compensation is owed for damage arising from the use of or inability to use the Service, from the loss of SmartSheets saved to the account or of content saved in the browser, or from reliance on inaccurate SmartSheets. Liability that the law does not allow to be excluded remains unaffected, in particular in cases of wilful misconduct or gross negligence, as do the rights that Italian consumer law grants to consumers.

8. Availability and usage limits

As a free demo, the Service may be suspended, modified or discontinued at any time, and its continuity is not guaranteed. There are also technical limits: a maximum number of requests per minute per user and a daily cap on total generations, imposed by the free tier of the Google APIs. When the cap is reached, the Service says so and you can try again the next day.

9. Personal data

Data processing is described in the Privacy Policy, which forms an integral part of these terms: read it, in particular the section on what happens to what you upload.

10. Changes to these terms

These terms may change: the version in force is always the one published on this page, with the update date at the top. Significant changes are flagged inside the application, which is where you will certainly see them: SmartSheet sends no promotional emails. By continuing to use the Service after a change, you accept it; if you do not accept it, stop using the Service — and you can delete your account.

11. Governing law and jurisdiction

These terms are governed by Italian law. For disputes with a consumer, the competent court is the one of the consumer’s place of residence or domicile, under the Italian Consumer Code.
